Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Dzmitry Tselabionak, operating as Nurelio (“Nurelio”, “we”, “us”) governing your use of the Nurelio mobile apps and website (the “Service”). Please read them carefully.

Where Nurelio is available

At launch Nurelio is offered in Canada, Australia, the United Kingdom, and the United States. You may of course travel with it, but we don’t offer or support the Service in other countries yet, and nutrition data coverage is strongest in the markets we’ve launched in.

Acceptance of these terms

When you affirmatively accept these Terms in the app, they govern your use of the Service. Our Privacy Policy explains our data practices, including the AI processing you agree to by using the app and the switch that turns it off. Product analytics and marketing emails remain separate choices that accepting these Terms does not make for you. If you do not agree to these Terms, do not use the app.

Eligibility

You must be at least 18 years old and legally able to enter into this agreement. The app is not intended for minors. If you no longer meet the eligibility requirements, contact us for help exercising your data rights and managing any existing subscription.

What Nurelio does

Nurelio helps you log meals, water, weight, and how you feel, and surfaces patterns unique to your body. The app is built local-first: your health data is stored on your device. AI features are on by default and can be switched off in Settings → Privacy & permissions. Some features need a connection and our servers to work — identifying a food you log, the AI coach chat, and the short summary on your score card. The coach and the summary send a working copy of your recent diary and profile basics with the request; our Privacy Policy sets out exactly what and why. Paid features are described at the point of purchase.

Not medical advice

Nurelio provides general information for nutrition, fitness, and wellbeing purposes only. It does not provide medical advice and does not diagnose, treat, cure, or prevent any condition. Any insights, patterns, or correlations Nurelio shows are for informational purposes and are patterns, not proof. Always consult a qualified healthcare professional before making decisions about your diet, health, or any medical condition, and never disregard professional advice because of something you saw in the app. If you think you may have a medical emergency, contact emergency services.

AI-generated content

Some features use artificial intelligence to interpret your input (reading a food from a photo, a description you typed, or the transcript of one you dictated) and to generate suggestions. AI output can be incomplete or inaccurate — please review it and use your own judgment before relying on it. AI-generated content is not medical advice. Nutrition quantities and food identification are estimates; verify ingredient labels, portions and allergens yourself. Do not rely on Nurelio to determine that a food is safe for an allergy, calculate medication doses, or manage a medical condition. Scores do not establish organ function or rule out illness. Discuss dietary changes with a qualified clinician, especially during pregnancy, when managing an eating disorder, or when taking medication. We do not guarantee weight loss, symptom improvement or another health outcome.

Your account

If you create an account, take reasonable steps to keep your device and credentials secure. You are not automatically responsible for unauthorized activity that is not your fault. Let us know promptly at privacy@nurelio.app if you suspect unauthorized use. Remember that your logged data lives on your device — uninstalling the app or losing the device may remove data that is not backed up through your own exports or backups. Apple Health does not contain a complete copy of your Nurelio diary, settings or conversations.

Subscriptions & billing

Nurelio may offer paid subscriptions that unlock additional features. If you subscribe:

• The current plans, prices, and any free-trial length are shown in the app before you confirm — the applicable offer and these Terms should be read together, subject to your statutory rights.
• Payment is charged to your Apple App Store account at confirmation of purchase.
• Where a plan includes a free trial, it converts into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Eligibility and the effect of cancellation are determined by the offer and Apple’s rules. Cancelling a trial may end trial access immediately.
• Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends.
• You manage and cancel your subscription in your App Store account settings — not by deleting the app. Cancelling keeps your access until the period you have already paid for runs out.
• You can request an App Store refund through Apple. This does not restrict refunds or other remedies required by law, or our obligations to you. We will give advance notice of subscription price changes as required by law and Apple’s rules, obtain any required consent, and give you an opportunity to cancel before a higher price takes effect.

Acceptable use

You agree not to: use the Service unlawfully; reverse engineer, decompile, or attempt to extract our source code except where the law expressly permits; interfere with or disrupt the Service or its security; circumvent fees or access controls; or use automated means to access the Service in a way that burdens our systems.

Your content

You own the data you create in Nurelio. Because that data is stored on your device, we don’t claim any rights to it. For the limited content a feature does send us — a food item submitted to be identified, or the recent-diary context behind a coach answer or score summary — you grant us a narrow, non-exclusive license to process it, and to have our processors handle it, only as needed to provide the feature you request, protect its operation and comply with applicable law, as described in the Privacy Policy and your consent choices. This license does not authorize advertising use, sale, publication of your private content, or training our own AI models. You must have the necessary rights to submit content, including information about other people.

Our intellectual property

The Service — including the app, website, design, logos, and content we provide — is owned by Nurelio and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service for your own personal, non-commercial use, subject to these Terms.

Third-party services

The Service integrates with third parties such as the Apple App Store, Apple Health, and the sign-in provider you choose. Your use of those services is governed by their own terms and policies, and those providers are responsible for their own services. This does not exclude our responsibilities for providers we engage or any rights you have under applicable law.

Terms that apply because you got Nurelio from the App Store

Apple requires a few specific points, and they’re fair enough to state plainly:

• This agreement is between you and us, not you and Apple, and we — not Apple — are solely responsible for Nurelio and its content.
• Apple has no obligation to provide support or maintenance for Nurelio.
• If Nurelio fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price; beyond that refund, Apple has no warranty obligation at all, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are ours to answer for.
• Apple is not responsible for addressing any claim you or a third party makes about Nurelio, including product-liability claims, any claim that it fails to conform to a legal or regulatory requirement, and claims under consumer-protection or privacy law.
• If a third party claims Nurelio infringes their intellectual property, we — not Apple — are responsible for the investigation, defense, settlement, and discharge of that claim.
• You confirm you are not located in a country subject to a U.S. Government embargo or designated as terrorist-supporting, and that you are not on any U.S. Government restricted-party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

The license permits use on Apple-branded products you own or control, subject to the App Store Usage Rules, including any applicable Family Sharing or volume-purchase rights. You must comply with applicable third-party agreements when using the app. Apple’s obligations are limited only to the extent permitted by law.

Disclaimers

Subject to the non-excludable rights below, and only to the extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We don’t warrant that the Service will be uninterrupted, error-free, or that any information (including nutrition data or AI output) is accurate or complete.

Your consumer rights come first, and nothing above touches them. Consumers in Australia have guarantees under the Australian Consumer Law, consumers in the UK have rights under the Consumer Rights Act 2015, and consumers in Canada and the US have equivalent protections under their own law. Those cannot be excluded, restricted, or modified by these Terms, and we don’t try to: where such a guarantee applies, it applies in full alongside everything in this section.

Limitation of liability

We are responsible for losses caused by our breach of these Terms or failure to exercise legally required care, to the extent required by applicable law. We are not responsible for losses that were not reasonably foreseeable when you accepted these Terms, or business losses arising from use of a service supplied for personal use, only where such exclusions are lawful and fair.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including for fraud, death or personal injury caused by negligence, mandatory consumer guarantees, or applicable privacy and data-protection remedies. These Terms do not impose a blanket monetary cap or require you to indemnify us for our own conduct. Local statutory rights apply even where another provision might suggest otherwise.

Termination

You can stop using Nurelio at any time by uninstalling the app. We may suspend or end access for a material breach or a reasonably substantiated security, legal or abuse risk. Where practicable, we will explain the reason and allow a reasonable opportunity to remedy a remediable breach; urgent action may be necessary to protect people or the Service. You may contact us to challenge a decision. We will honor any required refunds and, where lawful and reasonably practicable, provide an opportunity to export your local data. Stopping use or deleting an account does not cancel an App Store subscription. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and governing law) will continue to apply.

Changes to these terms

We may update these Terms for changes in law, security, service functionality or business operations. We will provide at least 30 days’ advance notice of material changes through the app or another appropriate channel, unless a legal requirement or urgent security issue requires a shorter period, which we will explain. Changes will not apply retroactively to existing disputes or remove accrued rights. Where agreement is required, we will ask you to accept the updated Terms. If you do not agree, you may stop using the Service and cancel renewal; we will provide any refund or other remedy required by law.

Governing law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, and the state and federal courts located in New York, New York have non-exclusive jurisdiction. This choice does not deprive you of mandatory protections or access to courts in your place of residence where applicable. There is no mandatory arbitration agreement or class-action waiver in these Terms.

If a provision is unenforceable, the remaining provisions continue to apply to the extent lawful. A failure to enforce a provision does not waive it. Any transfer of our obligations must preserve your mandatory rights.
